Le Conseil Présidentiel de Transition (CPT) a adopté, le mercredi 17 décembre 2025, un décret portant organisation et fonctionnement de la Haute Cour de Justice, publié au journal officiel « Le Moniteur ». Composé de sept chapitres et de vingt-huit articles, ce texte définit les règles de compétence, de procédure et de jugement applicables aux hauts responsables de l’État, poursuivis pour des crimes ou délits commis dans l’exercice de leurs fonctions.
Le décret précise que seule la Haute Cour de Justice est compétente pour connaître des poursuites visant le Président de la République, le Premier Ministre, les Ministres, les Secrétaires d’État ainsi que d’autres hauts responsables constitutionnels, lorsque les faits reprochés sont liés à l’exercice de leurs fonctions. Les infractions étrangères à ces fonctions relèvent des juridictions de droit commun.
Selon le texte, le Sénat de la République siège en Haute Cour de Justice. Les travaux sont dirigés par le Président du Sénat, assisté du Président et du Vice-Président de la Cour de cassation. Les décisions sont rendues sous forme de décrets, adoptés à la majorité des deux tiers des membres, conformément aux dispositions constitutionnelles.
Le décret encadre également la procédure de mise en accusation, qui relève exclusivement de la Chambre des députés. Celle-ci peut s’autosaisir à l’initiative des deux tiers de ses membres. L’acte de mise en accusation doit exposer les faits reprochés, les moyens invoqués et les qualifications pénales retenues. La Chambre des députés peut fonder sa démarche sur des arrêts de débet de la Cour Supérieure des Comptes et du Contentieux Administratif (CSCCA), ainsi que sur des rapports émanant d’institutions de lutte contre la corruption ou de renseignement financier, après validation par leurs organes compétents.
En phase d’instruction, la Haute Cour de Justice met en place une commission de trois membres chargée de conduire l’enquête, conformément aux règles applicables aux commissions parlementaires d’information et de contrôle. Cette instruction peut aboutir à un décret de non-lieu ou à un décret de renvoi. Le non-lieu entraîne le dessaisissement définitif de la Haute Cour. Le texte détaille par ailleurs le déroulement du procès, au cours duquel une commission spéciale soutient l’accusation, tandis que la défense bénéficie de l’ensemble des garanties prévues par la procédure pénale et les instruments internationaux relatifs aux droits humains. Les débats sont contradictoires et la défense a la parole en dernier.
Le verdict repose sur une question unique relative à la culpabilité de l’accusé. En cas de condamnation, la Haute Cour de Justice peut prononcer la destitution ainsi qu’une interdiction d’exercer toute fonction publique pour une durée allant de cinq à quinze ans. Le décret prévoit également la possibilité d’un renvoi devant les juridictions ordinaires, notamment pour l’application d’autres peines ou pour statuer sur l’action civile. Une disposition transitoire étend enfin l’application des règles prévues pour le Président de la République aux Conseillers-Présidents du Conseil Présidentiel de Transition, pour les crimes et délits commis dans l’exercice de leurs fonctions.
Pour rappel, le Conseil Présidentiel de Transition a été institué, à la suite de l’accord du 3 avril 2024, avec pour mission de rétablir la sécurité, d’organiser un référendum constitutionnel et des élections générales, en vue du retour à l’ordre constitutionnel. À ce jour, il reste 45 jours au CPT avant l’échéance prévue par cet accord.
