La violence multiforme des groupes armés en Haïti a provoqué la détérioration du niveau de vie de la population notamment les femmes et les filles de toutes les couches sociales, particulièrement celles qui sont démunies. Face aux crimes et au mépris des valeurs fondamentales des droits humains, particulièrement de la dignité, qui est inhérente à toute personne, sans aucune distinction; l’État, selon ses engagements, est chargé de protéger les femmes et de faire respecter leurs droits fondamentaux. Ensuite, il convient de faire le tour des principaux instruments nationaux, régionaux et internationaux de protection des femmes qui sont en vigueur, mais c’est toujours le silence face au calvaire des Haïtiennes.
Les femmes sont ainsi doublement victimes, comme citoyennes et comme femmes. Le corps féminin est objectivé comme un jeu par les bandits, qui, en toute impunité et à visière levée, le jour comme la nuit, provoquent des déplacements massifs de la population, comme l’a souligné un rapport de l’Organisation internationale pour les migrations (OIM).
La violence sexuelle, le viol collectif sont, entres autres, des formes de pratiques utilisées par les gangs armés pour déshumaniser les Haïtiennes lors des affrontements sanglants ou leurs prises de territoires. Le système judiciaire bande ses yeux face aux excès de pouvoir de ces individus.
Les femmes, victimes de violence, sont peu disposées à avoir recours à l’appareil judiciaire. Les victimes n’ont aucune confiance dans la capacité du système de justice à redresser les torts commis, et sont souvent maltraitées lorsqu’elles tentent de se prévaloir à des recours judiciaires. Cette combinaison de facteurs laisse chez les victimes un sentiment d’insécurité, de vulnérabilité, et de méfiance à l’égard de l’administration de la justice.
Alors qu’il revient aux autorités gouvernementales de mettre tout en œuvre pour faire prévaloir le respect des droits fondamentaux, notamment des femmes, mais l’État semble méprisé cet aspect de sa mission se faisant complice par son silence. Même le Ministère de la Condition Féminine et aux Droits de la Femme (MCFDF), se montre insouciant face à la mauvaise condition des femmes et des filles du pays qui vivent sous la dépendance des groupes armés.
