Le Conseil Présidentiel de Transition (CPT) a présenté un projet de décret visant à réguler l’exercice de la liberté d’expression, la presse et les communications en ligne. Le texte, composé de 24 articles et signé par 18 ministres, redéfinit les règles applicables aux médias traditionnels, numériques et aux réseaux sociaux. Selon le document, écrit, pour la plupart, par le cabinet du Conseiller-Président Emmanuel VERTILAIRE, l’objectif est de prévenir la diffamation, sanctionner les abus et renforcer la protection des journalistes.
Le projet de décret propose d’abroger le cadre juridique hérité de 1986 et de l’adapter aux réalités numériques actuelles. Il reconnaît la liberté d’expression comme un droit fondamental, tout en posant des limites liées à la dignité humaine et à l’ordre public. Il introduit également une protection renforcée des journalistes, incluant le recours à l’habeas corpus préventif.
Le texte criminalise la diffamation, les injures publiques, la diffusion de fausses nouvelles et les discours haineux. Les sanctions sont alourdies lorsque les infractions sont commises par voie électronique ou touchent un large public. Les plateformes numériques et les médias en ligne sont désormais soumis à des obligations claires, et le refus de coopérer avec la justice peut entraîner des amendes et des interdictions d’exercer.
Selon le projet, le CONATEL est désigné comme organe central de régulation, chargé de superviser l’ensemble des médias et des réseaux sociaux. Une publication annuelle des médias habilités est également prévue pour renforcer la transparence du secteur.
Présenté par le Gouvernement comme un outil de modernisation démocratique, ce décret suscite un débat parmi les observateurs. Certains y voient des limites potentielles à la liberté de la presse, tandis que d’autres préfèrent attendre son application effective avant de juger de son impact. La question centrale reste de savoir si le texte servira de rempart contre les abus ou constituera un test critique pour la liberté d’expression en Haïti.
