Affaire BNC: le Conseiller-Président Emmanuel VERTILAIRE exhorte le juge instructeur à surseoir à tout acte juridictionnel contre lui.
Le Conseiller-Président Emmanuel VERTILAIRE dit avoir informé le juge d’instruction Benjamin FELISMÉ de l’appel exercé contre son ordonnance-mandat de comparution sans prétendre s’immiscer dans ses investigations. Le membre du CPT a ainsi sollicité du magistrat instructeur de décliner sa compétence.
Dans un communiqué rendu public en date du 10 décembre 2024, le Bureau de communication du Conseiller-Président Emmanuel VERTILAIRE, sur le fondement des articles 185, 186 et 189 de la Constitution, ainsi que l’article 90 du code pénal, a sommé le juge Benjamin FELISME de surseoir à tout éventuel acte juridictionnel (demande d’interrogatoire par exemple) à son encontre dans l’attente de l’arrêt de la Cour d’Appel.
Le Conseiller-Président a aussi communiqué, par la suite, l’ensemble des pièces de la procédure d’instruction au greffe de la Cour d’Appel ce, en vertu de l’article 16 de la loi du 29 juillet sur l’appel pénal. Étant une autorité politique, Emmanuel VERTILAIRE dit porter toujours un grand intérêt à l’indépendance de la justice en tant que magistrat de formation.
Se voulant respectueux de la justice et en tant que magistrat, M. VERTILAIRE n’entend pas recourir à une défense de rupture contre les acteurs judiciaires dont le juge instructeur mais a porté de préférence la contestation de l’ordonnance de compétence du juge par devant la Cour d’Appel afin de trancher définitivement cette affaire.
Malgré le rapport jugé lacunaire et intéressé de l’ULCC, le Conseiller-Président VERTILAIRE renvoie ce dossier de la politique et préfère une solution juridique équitable à une justice politique, tout en reconnaissant son obligation d’information aux citoyens dans le cadre du dossier de corruption de la BNC.
