Affaire BNC : la Cabinet d’Avocats du Conseiller-Président Emmanuel VERTILAIRE saisit la cour d’appel.
Les avocats de la partie appelante ont officiellement sommé le juge d’instruction pour transmettre le dossier à la cour d’appel. Ils estiment que certaines conclusions préliminaires nécessitent un réexamen approfondi pour garantir une justice équitable. Cette action marque une étape décisive dans le traitement de cette affaire complexe.
En effet, ce lundi 9 Décembre 2024, le Conseiller -Président Emmanuel VERTILAIRE, en vertu de l’effet dévolutif de l’Appel, a sommé le juge d’Instruction Benjamin Félismé, d’avoir, dans un (1) jour franc pour tout délai, à transmettre au greffe de la Cour d’Appel de Port-au-Prince pour le compte du Commissaire du Gouvernement près de cette Cour, les pièces formant le dossier de l’enquête judiciaire ouverte contre ledit Conseiller -Président dans l’affaire de la BNC. Compte tenu de l’effet suspensif de l’Appel, le Conseiller Président Emmanuel Vertilaire n’est pas inculpé. Il compte aller jusqu’au bout pour ne pas laisser son image qu’il a construite pendant plusieurs années ternir.
L’appel, en tant que recours légal, a pour effet de suspendre temporairement toutes les décisions prises auparavant. Cette suspension vise à éviter des conséquences irréversibles tout en offrant aux parties concernées la possibilité d’être entendues par une juridiction supérieure. Pour les avocats, il s’agit de protéger les droits fondamentaux de leur client.
L’affaire d’Emmanuel VERTILAIRE, déjà au centre de nombreuses discussions, attire une attention particulière en raison des enjeux qu’elle soulève. Le rôle de la cour d’appel sera déterminant pour réexaminer les faits et les preuves, avec une objectivité attendue par toutes les parties.
