Violence des gangs : Les femmes, éternelles victimes du système
Haïti, première République noire du monde, fait face depuis plus de trois (3) décennies, à une crise multidimensionnelle qui perdure. L’insécurité constitue le point culminent de celle-ci. Elle est et entraine de graves violations des droits de la personne humaine. La violence en cours dans le pays continue de menacer le bien-être de tout un chacun, les enfants et les femmes notamment. En effet, la situation de la catégorie féminine devient de plus en plus alarmante. Pourtant, à Port-au-Prince comme dans certaines villes de province, les femmes insufflent la vitalité à la société, en se battant pour le respect des droits humains, pour la justice, l’équité de genre, contre l’impunité et la corruption.
Depuis le séisme du 12 janvier 2010, les femmes et les filles font face à des difficultés supplémentaires : manque d’accès à la planification familiale ainsi qu’aux soins prénataux et obstétricaux, violence domestique et sexuelle, pauvreté extrême. De surcroît, de fortes disparités par rapport aux hommes pèsent sur elles, dans le domaine de l’accès à l’éducation. Qui pis est, ces damnées du système sont souvent obligées de livrer leurs corps comme moyen de survie.
L’insécurité généralisée qui règne dans le pays est l’un des principaux facteurs qui favorisent la violence sexuelle et autres formes de violence basées sur le genre. Au regard de la constitution de 1987 et des conventions internationales relatives aux droits humains, l’État haïtien est responsable du maintien de la sécurité et de la protection des citoyens. Cette responsabilité inclut l’obligation spécifique de garantir la protection des femmes et des filles contre toutes les formes de violence liées au genre et l’obtention de réparation. Dans un contexte d’urgence humanitaire, la protection englobe toutes les activités visant à obtenir le respect complet des droits de l’individu, conformément à l’esprit de la législation relative aux droits humains (et éventuellement du droit international, du pacte interaméricain des droits de l’homme et sur les réfugiés). Elle couvre l’ensemble des droits humains, notamment les droits civils, politiques, économiques, sociaux et culturels. La majorité des instruments internationaux signée et ratifiée par Haïti oblige l’État à prendre toutes les mesures afin d’assurer le plein développement et le progrès des femmes.
Les femmes prises entre deux feux : la violence et l’exclusion
Marie Jeanne (nom d’emprunt) est une mère célibataire de 45 ans qui travaille depuis dix ans à la Société Nationale des Parcs Industriels (SONAPI). Elle joue les deux rôles (mère et père) pour ses deux enfants depuis la mort subite de son mari en 2016. Avec son salaire exécrable de moins de 1000 gourdes par jour, elle fait de son mieux pour prendre soin de sa famille sans aucune aide ou assistance des autorités.
« En tant que cheffe de famille, c’est à moi de dépenser plus de la moitié de ce montant quotidiennement en taxi et en nourriture, sans mentionner le loyer à une certaine époque, l’écolage de mes enfants, les vêtements et autres dépenses courantes. Après plusieurs années de dur labeur avec l’aide de quelques membres de sa famille à l’étranger, elle a construit sa maison, ce qui lui épargne le paiement du loyer. À cause de l’augmentation du coût de la vie et l’inflation galopante, la mère célibataire peine à répondre à ses responsabilités familiales.
« Après ses études, ma fille a vainement tenté de trouver du travail pour alléger mes charges. Après plusieurs tentatives, elle a abandonné et décidé d’entreprendre un petit commerce pour nourrir la famille », poursuit-elle.
Tout a basculé pour la famille de Marie Jeanne quand les gangs ont envahi la commune de la Croix-des-Bouquets notamment la zone de Duval où elle habitait. Elle a dû abandonner sa maison avec ses enfants pour aller se réfugier chez sa belle-sœur à Delmas. Les malfrats ont incendié des habitats parmi lesquels les trois pièces où elle vivait avec sa fille de 25 ans et son fils de 19 ans.
À quand la fin de la violence contre les femmes haïtiennes ?
La détérioration du climat sécuritaire ces dernières années, caractérisée par la prolifération des gangs armés dans presque tous les coins et recoins du pays et leurs tentatives très souvent fructueuses d’acquérir beaucoup plus de territoires, est venue exacerber la vulnérabilité de la gente féminine soumises à des
précarités. Il n’est donc pas surprenant que les femmes soient touchées de façon disproportionnée par la crise profonde qui affecte Haïti.
Il est déjà 10h, nous visitons les locaux du Lycée Jean Marie Vincent à Caradeux. Ce qui frappe, à première vue, c’est l’image choquante de ces déplacés pour la plupart des femmes et des filles ayant été forcées de fuir leurs résidences, parfois sans leurs parents, en vue de trouver un refuge paisible, après avoir été gazés puis pourchassés par les forces de l’ordre devant les locaux de l’ambassade américaine à Tabarre, un quartier contrôlé par les bandes criminelles. Les gens sont délaissés ; des enfants sont allongés sur le ventre à même le sol. Pour tout barrage, certains utilisent des draps. La situation est plus que lamentable. Les réfugiés ne sont pas à l’abri du soleil écrasant, n’en parlons pas de la pluie. Sur la cour du lycée un tas d’immondices flirtent avec des eaux stagnantes et puantes.
L’espace n’est ni sécurisé ni contrôlé, tout se mélange et tout se confond : personnes humaines et choses matérielles. Les déplacés de Tabarre sont dans une situation critique. Livrés à une promiscuité totale et abandonnés à leur sort, ils tentent de survivre.
« J’ai dû brusquement courir, sans avoir eu le temps de prendre grande chose dans la maison. Je n’ai que les seuls habits que je porte », témoigne; la mort dans l’âme, Jacqueline (nom d’emprunt). Elle est également mère célibataire et ne sait à quel saint se vouer avec deux fils sur le bras.
« Je vis difficilement cette situation qui nous fait perdre une part de notre dignité. Selon ce que j’ai appris, les bandits armés ont dit que les personnes qui se sont déplacées ne doivent pas espérer retourner », soupire une jeune mère qui dit n’avoir pas assez d’eau et de nourriture, pas de matelas pour se coucher en plus l’absence de toilettes convenables dans l’espace.
L’histoire de Jacqueline est loin d’être anodine voire unique.
Madeleine (nom d’emprunt), fait partie des premiers déplacés. Elle dit se sentir gênée de chercher à s’adapter à cette situation.
« On est abandonné entre les mains des gangs qui nous empêchent de vivre normalement. Les membres de gang rentrent chez les gens, les violent, incendient leurs maisons et les tuent. Nous, les femmes, sommes victimes de viols à répétition. Je souhaite retourner chez moi, reprendre mes activités dans la dignité. Cependant, le moment n’est pas propice, je suis obligée de rester ici en attendant un cessez-le-feu », déplore la jeune femme qui frise la trentaine.
« Les toilettes sont défectueuses, pour effectuer un besoin, on doit se rendre aux toilettes publiques où on doit payer cinquante gourdes et ces toilettes sont dans un piteux état. Nous, les femmes et les filles, n’avons presque plus d’intimité pour effectuer un besoin ou nous baigner », se lamente-t-elle.
Au cœur du calvaire des femmes : l’irresponsabilité de l’Etat
Les citoyens ont condamné la faible riposte donnée par les autorités face à la guerre ouverte déclarée par des bandits et criminels notoires aux paisibles citoyens. Une guerre qui met en péril la stabilité, la paix, la sécurité, le développement du pays.
« Je condamne aussi la manière forte employée par les forces de sécurité nationale, en dehors de toute tentative de dialogue ou de médiation, pour déloger les familles massées dans les centres d’hébergement pour fuir la criminalité, le vol, le viol, le kidnapping généralisé», a déploré cette étudiante en 3ème année de Sciences Juridiques.
Ainsi, elle invite les autorités à agir vite en vue de mettre fin à ce cycle de violences en adoptant des dispositions pour rétablir la sécurité, pour garantir le droit à la vie, la libre circulation des citoyens. Il a dit constater que les droits de l’homme sont en nette régression en Haïti depuis la déclaration de guerre officielle des bandits contre la population.
Elle croit que les autorités étatiques semblent oublier leur mission qui consiste à protéger la vie des citoyens, (femmes, enfants, personnes âgées), menacés par l’arbitraire, la barbarie, la criminalité démoniaque, comme c’est le cas des nombreuses familles chassées de leur domicile par les hommes armés opérant à visière levée.
« Le retour des déplacés internes à leurs domiciles est une obligation et une responsabilité des autorités du pouvoir central pour rompre ce grand silence d’État », a exigé, pour sa part, le Protecteur du Citoyen, Me Renan Hédouville.
De son côté, la Responsable de Programmes au Réseau National de Défense des Droits Humains (RNDDH), Marie Rosy Auguste Ducénat, a déclaré que la violence généralisée des gangs a un impact particulier sur les femmes, arguant que celles-ci sont victimes directement et collatéralement.
« Le viol et l’esclavage sexuel sont utilisés par les gangs comme arme pour terroriser et affirmer leur contrôle sur les populations des zones qu’ils convoitent et les forcer à fuir leurs résidences pour se réfugier dans des endroits inappropriés», explique-t-elle, tout en rappelant que cette situation est préjudiciable à la protection des droits fondamentaux de la personne et plus particulièrement ceux des femmes et des filles.
En ce qui concerne les déplacements internes, la défenseure des droits de l’homme a fait savoir que la fuite est la seule forme de résistance de la population face à la violence généralisée des gangs. Elle attire l’attention sur les espaces où se réfugient ces citoyens qui ne sont pas appropriés. De plus, les autorités étatiques n’ont entrepris aucune démarche visant la prise en charge des rescapés.
« Beaucoup de cas de viols collectifs ont été recensés sur des places publiques et d’autres endroits où les déplacés se sont réfugiés. » Dans ces espaces, il n’y a pas d’intimité et les déplacés dorment à même le sol. Pas d’électricité et pas assez de toilettes, cela ne fait pas honneur à la condition humaine. En plus, les déplacés ne sont pas en sécurité. », souligne la militante.
Marie Rosy Kesner Auguste Ducénat croit que, du fait que les yeux sont rivés sur l’insécurité et la terreur instaurée par les gangs, la violence sexuelle, conjugale, domestique et d’autres formes de violence dont sont victimes les femmes et les filles sont en nette augmentation et échappent à la société. Elle accuse les autorités de n’avoir mis en place aucune politique de protection civile pour la population, notamment les femmes, les enfants et les personnes vivant avec des déficiences physiques et motrices.
« Le droit à la vie et à la sécurité font partie des droits fondamentaux de la personne, mais aucun mécanisme n’est mis en place par les autorités pour le respect de ces droits. L’Etat a failli à sa mission de protection et de respect de la dignité humaine », s’indigne-t-elle.
Selon des experts internationaux en matière de déplacements internes, les personnes déplacées de force en raison d’un conflit ou d’une catastrophe naturelle ou provoquée par l’homme sont plus exposées à des atteintes aux droits humains.
Des communautés qui étaient déjà en danger sont devenues encore plus vulnérables aux violences après avoir été déplacées, puisqu’elles ont été privées des réseaux qui leur
apportaient un certain soutien et leur permettaient de subvenir à leurs besoins et à ceux de leur famille.
L’expression « Violence à l’égard des femmes », selon l’article 1er de la Déclaration sur l’élimination de la violence à l’égard des femmes, désigne « tout acte de violence dirigé contre le sexe féminin, et causant ou pouvant causer aux femmes un préjudice ou des souffrances physiques, sexuelles ou psychologiques, y compris la menace de tels actes, la contrainte ou la privation arbitraire de liberté, que ce soit dans la vie publique ou dans la vie privée ».
Cette définition est renforcée par l’article 2 de la Convention interaméricaine qui entend par violence contre la femme : « la violence physique, sexuelle ou psychique se produisant dans la famille ou dans le ménage ou dans toute autre relation interpersonnelle, que l’agresseur ait partagé ou non la même résidence que la femme, se manifestant, entre autres, sous forme de viols, mauvais traitements ou sévices sexuels ; se produisant dans la communauté, quel qu’en soit l’auteur, et comprenant entre autres, les viols, sévices sexuels, tortures, traite des personnes, prostitution forcée, séquestration, harcèlement sexuel sur les lieux de travail dans les institutions d’enseignement, de santé ou tout autre lieu ; et perpétrée ou tolérée par l’État ou ses agents, où qu’elle se produise ».
Fort de ces considérations, le constat est qu’en matière de violences faites aux femmes, l’État haïtien a tout simplement abdiqué. Il a, pour une large part, abandonné ses prérogatives et engagements. Par exemple, à l’article 7 de la Convention de Belém do Pará, il est mentionné que l’État a l’obligation d’agir avec diligence afin de sanctionner les actes de violence envers les femmes.
Jusqu’à maintenant, aucune mesure n’a été prise
en faveur de la catégorie féminine, alors qu’il incombe à l’État la responsabilité d’assurer la protection des droits des femmes et de veiller à l’effectivité du droit à la non-discrimination. Or, il n’en est rien.
Les femmes continuent d’être la cible privilégiée des bandits armés. Donc, les principales et éternelles victimes d’un Etat moribond, peut-être complice mais surement incompétent.
