L’Unité de Lutte Contre la Corruption (ULCC) a publié, ce jeudi 8 mai 2025, un rapport de 48 pages contenant plusieurs données frauduleuses sur plusieurs fonctionnaires publics, parmi lesquelles figure le nom de Gerline JOSEPH, cheffe du service de l’enregistrement et des opérations domaniales à la Direction Départementale des Impôts du Centre (DDI-C), mise en cause pour des faits présumés d’abus de fonction, de favoritisme et de faux en écritures publiques.
L’affaire remonte en juin 2023, à la suite d’une plainte déposée par Étienne Pierre DERELUS. Ce dernier affirme avoir été victime d’un acte de corruption dans le cadre d’un litige foncier à Couette Sully, commune de Hinche. Selon la plainte, DERELUS avait obtenu en janvier 2020 un certificat de cession de droit de fermage, hérité de sa défunte mère, qu’il avait cédé six mois plus tard à Jean Paul Joseph par acte notarié.
Cependant, le nouveau cessionnaire a été écarté du terrain par Mme Carole DALUSMA, qui y a érigé une clôture en se présentant comme fermière régulière de l’État. L’enquête de l’ULCC révèle que cette dernière a obtenu un bordereau de droit de fermage en août 2021, avec l’approbation directe de Gerline JOSEPH.
L’organisme de contrôle souligne que Mme JOSEPH a outrepassé ses attributions légales en délivrant ce document sans l’autorisation préalable du Directeur Général de la DGI, en violation du décret du 22 septembre 1964. Lors de son audition, la fonctionnaire a reconnu avoir agi sans se référer à un arrêt de la Cour de cassation, qui ordonnait un partage du terrain entre les parties. Elle a admis s’être fiée uniquement aux déclarations de Mme DALUSMA, sans comprendre pleinement la portée juridique de la décision.
Le rapport pointe également un lien personnel entre les deux femmes, qui se connaissent depuis l’enfance et partagent la même confession religieuse en tant que Témoins de Jéhovah. Ce lien, selon l’ULCC, aurait influencé la décision de Mme JOSEPH, en violation de l’article 5.13 de la loi du 12 mars 2014 sur la prévention et la répression de la corruption.
Qui pis est, Gerline JOSEPH est accusée de faux en écritures publiques pour avoir modifié un bordereau afin de justifier un droit de fermage irrégulier à Mme DALUSMA. Cet acte, qui punit de travaux forcés à perpétuité tout fonctionnaire ayant commis un faux dans l’exercice de ses fonctions, que ce soit par fausses signatures, altération de documents, supposition de personnes ou ajout frauduleux par l’article 107 du Code pénal haïtien, est renforcé par les articles 108 à 126 et 217 du même Code, les articles 215 et suivants du Code de procédure civile, et 350 et suivants du Code d’instruction criminelle.
l’ULCC conclut en recommandant la suspension administrative de Mme JOSEPH, dans l’attente d’une décision judiciaire, ainsi que le renforcement des mécanismes de contrôle et de formation au sein de la DGI. Elle demande en outre que l’action publique soit engagée pour abus de fonction, favoritisme et faux en écritures publiques, des infractions représentant une atteinte grave à l’intégrité de l’administration publique.
Alors que l’ULCC a rempli sa mission, il appartient désormais au parquet de mettre en mouvement l’action publique contre celle qui circule encore librement dans les rues de la capitale haïtienne.
