Éditorial : Une justice en veille face à une corruption active, avec des rapports pour l’impunité
Quand l’ULCC parle, la justice reste silencieuse. Et quand elle alerte, la justice bloque. Le résultat sera sans doute un long combat inégal à mener contre l’impunité.
Entre 2020 et 2024, sous la direction de Hans Jacques Ludwig JOSEPH, l’ULCC a transmis 56 rapports au Parquet de Port-au-Prince. Ce chiffre représente plus de 60 % des dossiers envoyés à la justice depuis la création de l’institution en 2004. Un effort considérable, qui témoigne d’un travail renforcé d’enquête sur des cas présumés de corruption, de détournement de fonds publics, de surfacturation, d’enrichissement illicite, entre autres, fautes graves.
Mais ce travail est resté lettre morte. Aucun de ces rapports n’a conduit à une arrestation ni à des poursuites judiciaires concrètes. Pas moins de dix personnes, pourtant directement mises en cause, n’ont jamais été inquiétées. Malgré des preuves solides et des dénonciations bien étayées, les dossiers sont classés sans suite dans les tribunaux de première instance des 18 juridictions du pays, notamment au Parquet de Port-au-Prince.
Cette situation révèle un grave dysfonctionnement. D’un côté, une institution produit des enquêtes sur des dossiers de corruption avérés. De l’autre, une justice silencieuse, qui semble fermer les yeux, surtout lorsque les personnes impliquées occupent des postes influents. Ce contraste renforce l’idée d’une justice à deux vitesses, où certains jouissent d’une protection tacite.
La question se pose : à quoi bon enquêter si personne n’est jamais jugé voire puni ? L’inaction des autorités judiciaires jette le discrédit sur l’ensemble des efforts de lutte contre la corruption. Elle décourage les dénonciations, alimente l’impunité et laisse entendre que les actes de corruption peuvent se poursuivre sans crainte de sanction.
Ce blocage met en lumière un véritable problème de gouvernance. Il montre l’absence de communication entre les institutions ou, pire, leur neutralisation mutuelle. Pourtant, sans une justice qui agit, aucune lutte contre la corruption ne peut être crédible.
Le peuple haïtien mérite mieux. Il mérite une justice active, des responsables tenus pour comptables, et une administration qui défend l’intérêt général et non les privilèges d’une minorité.
