Alors que le torchon brûle entre les deux pays partageant l’île d’Haïti suite à la construction du canal, côté haïtien, au niveau de la rivière massacre; les propositions et appels au dialogue pleuvent de part et d’autre.
En effet, après les appels lancés par l’Organisation des Etats Américains (OEA) l’ancien ambassadeur d’Haïti en République Dominicaine, Smith AUGUSTIN, considéré comme l’une des personnes les mieux placées pour opiner sur dossier et conviancu que seules les voies diplomatique et du dialogue franc peuvent aboutir à une solution commune à ce conflit, fait une proposition de sortie de crise baptisée : Proposition d’une structure de conciliation pour une résolution pacifique du conflit sur la rivière Massacre.
En ce sens, une correspondance a été adressée au premier ministre Ariel Henry.
Cette proposition consiste à la mise en place d’une commission bilatérale de conciliation, assistée d’un agent conciliateur international; soit un représentant d’un État tiers ou d’une organisation internationale dont les deux États sont membres, dont la principale mission sera de mener les discussions.
L’ex chef de la mission diplomatique haïtienne en république dominicaine présente, à travers sa correspondance, la méthode à suivre en vue de la mise en place de ladite commission ainsi que les différentes étapes de son travail.
1- Première étape: La République dominicaine répond positivement à l’invitation au dialogue du gouvernement haïtien en échange d’une déclaration d’engagement de celui-ci signifiant sa prise en charge officielle du projet de construction du canal. Les deux États choisissent d’un commun accord l’agent conciliateur international.
2- Deuxième étape: En acceptant de revenir à la table de dialogue, le gouvernement dominicain procède à la levée TEMPORAIRE de ses récentes mesures (fermeture des frontières, interruption de l’émission de visas aux Haïtiens, interdiction d’entrée, etc.) et s’engage à n’entreprendre présentement aucun ouvrage parallèle sur la Rivière Massacre. Le gouvernement haïtien, pour sa part, décrète la suspension TEMPORAIRE des travaux de construction du canal sur la même rivière pour évaluation.
3- Troisième étape: Les deux États créent une Commission Bilatérale de Conciliation (CBC) et désignent ses membres respectifs. Ladite Commission comprendra 12 membres, six membres de chaque côté choisis en fonction de leurs homologues respectifs : (1) le Chef de la mission diplomatique haïtienne en République dominicaine / son homologue en Haïti, (2) le Secrétaire technique/exécutif de la Commission mixte haïtiano-dominicaine, (3) le directeur technique des frontières (Haïti)/directeur de la direction Limites et Frontières (RD), (4) un technicien de haut niveau en ingénierie hydraulique, (5) un technicien de haut niveau en études environnementales et (6) un juriste spécialisé de préférence en droit du contentieux international.
4- Quatrième étape: Ouverture des travaux de la CBC sous les auspices du conciliateur. Principaux points de l’agenda : a)- (re)définition conjointe du sujet de la controverse, du siège de la commission et des règles de la procédure de conciliation dont la signature de la déclaration conjointe d’un engagement pour le respect et l’application obligatoires des délibérations finales (article 6, traité de 1929); b) élaboration des termes de références en vue du recrutement d’une firme internationale neutre (afin d’éviter tout conflit d’intérêt) ou la formation d’une équipe binationale haïtiano-dominicaine (Direction Évaluation Impact Environnemental en RD / Bureau National d’Évaluation Environnementale (BNEE) du Ministère de l’environnement en Haïti) pour une étude d’évaluation des impacts binationaux de nature environnementale et sociale du projet haïtien en cours et des projets dominicains existants sur la Rivière Massacre.
5- Cinquième étape: Deuxième rencontre de la CBC : Approbation, après l’autorisation conjointe des deux gouvernements, du recrutement de la firme ou de la mise en place de l’équipe binationale d’évaluation, validation des activités et du budget de l’étude.
6- Sixième étape: Conduite de l’étude en 30 à 45 jours ouvrables et soumission du rapport final à la CBC. Points clés à traiter dans le rapport: a) description et analyse de l’état des sites; b) description et analyse des projets; c) description et analyse de tous les éléments et ressources naturels et sociaux affectés ou susceptibles d’être affectés par la réalisation de ces projets; d) indication des mesures prévues pour éviter, réduire, éliminer ou compenser les effets dommageables; e) recommandation d’un plan de construction et de gestion environnementale.
7- Septième étape: Troisième rencontre de la CBC : Présentation des résultats de l’étude, discussions, négociations et délibérations finales. » Souligne-t-il dans correspondance.
Tout en reconnaissant les valeurs juridicque des autres propositions de sotie de crise dont le saisissement des organismes internationaux ou régionaux, des firmes internationales de consultation juridique entre autres… l’ambassadeur Smith AUGUSTIN estime que celles-ci peuvent être très couteuses et/ou durables or, le problème né de la construction du canal au niveau de la rivière massacre doit être abordé avec célérité considérant qu’il mine les relations entre les deux peuples.
