Ce 7 juillet 2024, marque le troisième anniversaire de l’assassinat de l’ancien président, Jovenel Moïse. En Haïti, depuis après l’ordonnance du juge d’instruction, aucune action concrète n’est posée au niveau de la justice haïtienne. Cependant, la justice américaine quant à elle; est plus proche de la vérité. On est loin d’un procès équitable.
7 juillet 2021- 7 juillet 2024, trois années déjà depuis que l’ancien président Jovenel Moïse, a été tué chez lui, à Pèlerin 5. Il a été criblé d’au moins 12 balles. La veuve du président, Martine Moïse a été grièvement blessée par balles le soir de ce meurtre.
La justice américaine constitue les pièces du puzzle
Le juge du tribunal fédéral de Floride, José Martinez a condamné les 6 hommes reconnus coupables à verser environ 6.2 millions de dollars à la veuve et le fils aîné, du 58e Chef d’Etat d’Haïti. Martine Moïse aura une restitution de 5 305 387 dollars pour couvrir ses frais médicaux, ses déplacements et la sécurité qu’elle a dû engager entre autres.
Jovelin Moïse, le fils du président, percevra 865 396 dollars. Les raisons de cette indemnisation ne sont pas explicitement mentionnées dans l’ordonnance. Joseph Joël John, Rodolphe Jaar, German Rivera, Mario Antonio Palacios, Joseph Vincent, ont été reconnus coupables et ont été condamnés à perpétuité par la justice américaine pour leur implication dans le complot.
Frederick Bergmann, a été condamné à neuf ans de prison pour avoir enfreint les lois fédérales destinées à maintenir les États-Unis à l’écart des conflits à l’étranger. Quelle est la prochaine étape dans cette affaire qui fait durer le suspense ?
En Haïti, la quête de justice est loin d’être achevée
De juillet 2021 à date, cinq juges d’instruction:Mathieu Chanlatte, Gary Orélien, Chavannes Etienne et Merlan Belabre; ont été désignés pour enquêter autour de ce qui s’est passé dans la nuit du 6 au 7 juillet 2021. Ces derniers ont été soit déportés ou écartés sans toutefois rétablir la vérité. Finalement, le doyen du tribunal de première instance de Port-au-Prince, Me Bernard Saint-Vil avait désigné le juge instructeur Walter Wesser Voltaire pour instruire le dossier en mai 2022.
Après plus de 20 mois d’instruction, le juge instructeur Walter Wesser Voltaire a finalement rendu son ordonnance en février dernier. Dans son ordonnance, le juge d’instruction chargé de l’enquête ordonne qu’une cinquantaine de personnes soient jugées.
Martine Moïse, femme du défunt, Félix Badio, présenté comme l’un des planificateurs de l’assassinat, Léon Charles, ancien chef de la police et Dimitri Hérard, ancien commandant de l’Unité de Sécurité générale du Palais National, Claude Joseph Premier ministre d’alors entres autres sont inculpés dans le dossier. Ils ont été renvoyés par devant le Tribunal criminel. Les concernés ont rejeté cette décision.
L’ordonnance a innocenté l’ex-Premier ministre Ariel Henry et l’ancien sénateur Antonio Cheramy, entre autres. Jusqu’à date, c’est le silence radio de la justice autour de l’affaire de Jovenel Moïse. La dernière personne appréhendée est Joseph Félix Badio, qui n’est pas extradé comme les autres personnes impliquées dans ce meurtre.
3 ans après la justice haïtienne n’arrive pas à identifier les auteurs intellectuels de cet assassinat, ni les bras financiers. Dans un pays où règne l’injustice et l’impunité, peu de gens croient à cette question de justice pour le feu président car avec un système judiciaire défaillant et rongé par la corruption. La défaite de la justice est provisoire mais le suspense reste plané.
