Haïti – Justice : Le CARDH et l’IMED initient une première séance d’habeas corpus pour décongestionner le CERMICOL
Le Centre d’Analyse et de Recherche en Droits de l’Homme (CARDH) et l’Institut Mobile d’Éducation Démocratique (IMED) ont organisé, le lundi 19 janvier 2026, au Tribunal de Première Instance (TPI) de Port-au-Prince, la première séance collective d’habeas corpus en faveur de 21 détenus du Centre de Rééducation des Mineurs en Conflit avec la Loi (CERMICOL).
Cette initiative s’inscrit dans le cadre du projet intitulé Initiative mobile pour la réduction de la surpopulation carcérale et de la détention préventive prolongée, mis en œuvre pour une durée de cinq mois. Le projet est porté par le Ministère de la Justice et de la Sécurité Publique (MJSP) et exécuté avec l’appui financier du Programme des Nations Unies pour le Développement (PNUD). Il vise à contribuer à la décongestion des centres de détention et au respect des garanties constitutionnelles.
La séance s’est tenue sous la direction du doyen du TPI de Port-au-Prince, Bernard SAINT-VIL et ministère public était représenté par le chef du Parquet, Patterson DORVAL, assisté du substitut Choubert BAPTISTE. Les 21 personnes concernées sont actuellement détenues au CERMICOL.
Il s’agit de Wisnel SAINT-FLEUR, Roosevelt D’HAÏTI, Djenix GEORGES, Joseph WILLIAM, Doune JULES, Cliford DORVIL, Verguens EMISCA, Alex LOUIS, Alain SÉRAPHIN, Félix MERCIER, Ebel JESSICA, Glesil CASSANDRA, Pierre ERNEST, Accime JESUSLA, Rose Mada CALIXTE, Catherine INNOCENT, Medwina PIRISTIN, Stéphanie TREZILUS, Robert Assela ROBERTO et Rodly JEAN. Selon les organisateurs, la décision judiciaire relative à leur situation est attendue pour ce mardi 20 janvier 2026.
Cette démarche intervient dans un contexte marqué par la persistance de la détention préventive prolongée et la surpopulation carcérale en Haïti. Les conditions de détention dans plusieurs établissements pénitentiaires du pays font régulièrement l’objet de dénonciations.
D’après le document de présentation du projet, plusieurs actions sont prévues, notamment la reconstitution de dossiers judiciaires détruits ou perdus lors d’attaques contre des prisons, l’accélération du traitement des dossiers en état d’être jugés et l’organisation de séances collectives d’habeas corpus pour des personnes poursuivies pour des infractions mineures. Le projet prévoit également la tenue d’audiences correctionnelles pour des détenus ayant déjà purgé la durée légale de leur peine.
Toujours selon les responsables, d’autres mécanismes constitutionnels et légaux devront être mobilisés pour contribuer au désengorgement des centres de détention. Les zones d’intervention du projet couvrent notamment Port-au-Prince et Jacmel.
