Refus d’ouverture d’information judiciaire : Emmanuel Vertilaire, Conseiller-Président, défend son intégrité
Emmanuel VERTILAIRE, Conseiller-Président de la République d’Haïti, se trouve plongé au cœur d’une controverse médiatique suite à des accusations de corruption qui agitent le pays. En réaction à ces allégations, son avocat, Me Guerby BLAISE, a déposé une demande formelle visant à contester l’ouverture d’une information judiciaire à l’encontre de son client.
Emmanuel VERTILAIRE, dont le parcours se distingue par une carrière éminente en tant que magistrat et professeur de droit, fait face à des accusations sérieuses selon lesquelles il aurait sollicité un pot-de-vin de 100 millions de gourdes pour influencer la reconduction de Raoul PIERRE-LOUIS à la présidence du Conseil d’Administration de la Banque Nationale de Crédit (BNC). Ces allégations, largement diffusées dans les médias et sur les réseaux sociaux, soulèvent des interrogations profondes quant à l’intégrité du processus judiciaire en Haïti.
Dans sa requête, Me BLAISE a mis en avant l’immunité présidentielle dont bénéficie son client, en accord avec la Constitution haïtienne. L’article 24-1 stipule qu’aucune poursuite ne peut être engagée sans respecter les procédures légales établies. De plus, l’article 186 exige qu’une majorité des deux tiers de la Chambre des Députés soit requise pour toute mise en accusation d’un membre du gouvernement, garantissant ainsi que les fonctionnaires puissent exercer leurs fonctions sans crainte d’interférences politiques.
Fort d’une carrière politique débutée en 1997 et ayant occupé divers postes judiciaires avant d’accéder à la présidence, Emmanuel VERTILAIRE se consacre actuellement à renforcer l’État de droit en Haïti. Il soutient que les accusations portées contre lui sont une tentative délibérée de saper ses efforts en faveur de l’indépendance de la justice.
La demande de refus d’ouverture d’information judiciaire sera examinée par le juge d’instruction près le tribunal de première instance de Port-au-Prince, Benjamin Félismé. La décision de la cour pourrait avoir des répercussions significatives tant sur la carrière de Monsieur VERTILAIRE que sur l’image de l’administration actuelle, déjà sous pression.
L’affaire est scrutée de près par l’opinion publique, divisée entre ceux qui soutiennent l’innocence de Vertilaire et ceux qui expriment des inquiétudes quant à la transparence et à la responsabilité des dirigeants dans un contexte où la corruption a érodé la confiance du peuple.
La situation reste donc sous haute surveillance, car les développements de cette affaire pourraient influencer le climat politique en Haïti dans les mois à venir, avec des enjeux cruciaux pour l’avenir de la gouvernance et de la justice dans le pays.
